This document describes the legal terms governing the use of the Kwizmo platform and related services.
These Terms govern access to and use of the Kwizmo platform (“Platform”) operated by Kwizmo d.o.o. (“Kwizmo”, “we”, “us”).
By accessing or using the Platform you agree to these Terms.
If you access the Platform on behalf of an organization, you confirm that you have authority to bind that organization.
If a separate written agreement exists between Kwizmo and a customer, that agreement prevails over these Terms in case of conflict.
Kwizmo provides a cloud-based platform that enables organizations to create, manage, and deploy artificial intelligence assistants, knowledge systems, and automated workflows.
The Platform may include integrations with third-party services and artificial intelligence models.
Kwizmo may modify or update the Platform at any time.
Users may be required to create an account.
The customer organization is responsible for activities performed under its accounts.
Where an unlimited AI agent usage plan is agreed, such usage is intended for normal human-operated business activities and remains subject to fair use and platform stability protections.
“Fair use” means customers may use the services without predefined usage caps for their ordinary and intended business operations, provided that such usage does not:
Kwizmo reserves the right to apply temporary throttling, request queuing, prioritization adjustments, commercial review, or plan modification where usage materially exceeds normal business usage patterns or threatens platform stability for other customers.
The Platform may not be used to:
Customers retain ownership of all data uploaded or processed through the Platform (“Customer Data”).
Customers grant Kwizmo a limited license to process Customer Data solely for the purpose of operating the Platform.
Kwizmo does not use Customer Data to train AI models unless explicitly agreed.
The Platform may generate responses using artificial intelligence technologies.
Customers are responsible for reviewing outputs before relying on them.
All rights to the Platform, including software, algorithms and documentation, remain the property of Kwizmo.
The Platform may integrate services from third parties including AI model providers and infrastructure providers.
Kwizmo aims to maintain reliable access but does not guarantee uninterrupted service.
Kwizmo shall not be liable for indirect or consequential damages including loss of profits, business interruption, or reliance on AI-generated outputs.
Kwizmo may suspend or terminate access if these Terms are violated or if required for security or legal reasons.
These Terms are governed by the laws of the Republic of Slovenia.
Kwizmo d.o.o. acts as the controller of personal data processed through the website and platform administration functions.
Processing is based on contractual necessity, legitimate interests, legal obligations, or consent where applicable.
The smallest possible quantity of information and knowledge base relevant to the question or task given to Kwizmo is shared with cloud providers, AI service providers, and technical infrastructure partners.
Personal data is retained only as long as necessary for service operation or legal obligations.
Users have rights under GDPR including access, correction, deletion, restriction of processing, objection, and data portability.
Users must not use the Platform to generate or distribute:

Customer acts as Data Controller. Kwizmo acts as Data Processor.
Kwizmo processes personal data only for the purpose of providing the Platform.
Kwizmo implements appropriate technical and organizational measures to ensure data protection.
